According to Indian law, people over 18 can travel anywhere and stay in a hotel. This right is protected by Article 21 of the Constitution, which guarantees the privacy and personal freedom of the individual. If an unmarried couple stays in a hotel, they cannot be arrested on this basis alone.

If the police raid a hotel and find a couple there, there is no legal basis for arresting them without any allegation of criminal activity. According to a media report, experts say that if the girl and the boy are together with mutual consent, the police cannot act against them. However, if the girl makes serious allegations or changes her statement, the situation may change, and the matter may also go to court.

In 2019, the Madras High Court clarified that unmarried couples staying in a hotel is neither illegal nor a crime. The court said that a live-in relationship between adults is not a crime. The Delhi High Court in 2009 and the Madras High Court in 2013 also took the same decision.
