On the other hand, the Supreme Court has made a significant comment on the misuse of laws protecting women from harassment. The apex court has said that strict laws made for the welfare of women are not made to ‘punish, threaten, suppress or extort money’ from husbands.
Justice BV Nagarathna and Justice Pankaj Mittal said Hindu marriage is a sacred bond, the family’s foundation, not a ‘business deal’. The Supreme Court made this comment while settling a matrimonial dispute. The apex court also quashed all the criminal cases filed by the wife against the husband.
Let us tell you that this was a divorce case between a separated couple. In it, the husband was ordered to pay the wife permanent alimony of Rs 12 crore. The court expressed concern over cases where the wife and her family use criminal complaints to extort money from the husband and his family.
According to the apex court, the police sometimes tact hastily and even arrest the husband or his relatives. It is also difficult to get bail in such cases. The court said that wives should remember that these laws are for their welfare and not to harass husbands.
A bench of Justice BV Nagarathna and Justice Pankaj Mittal of the Supreme Court said that the laws made for the welfare of women are not made to ‘punish, threaten, suppress or extort money from’ their husbands. He said – Hindu marriage is a sacrament and a sacred bond, which has been given great importance in Indian society. Marriage is not a commercial transaction. It is a holy bond.
“Even petty disputes between husband and wife turn into ego and ugly spats in public, which ultimately spoils the relationship to such an extent that there is no possibility of reconciliation or living together,” the judges said.
